Tenant Notices Required by Law


Product Description

We prepare and serve five day notices for non-payment of rent, ten day notices of material breach or any other type of notice you need.  The notices are on our law firm letterhead.  You have two options for service of the notice. 

  • Certified Mail Only: Service by Certified mail satisfies the notice requirements of the Arizona Landlord Tenant Act.  However, it can add, at most, five days to the date on which you can file the eviction lawsuit.  The five days notice required by law begins to run on the day the tenant signs the receipt on the certified mail form.  If the tenant never signs, the law presumes that they received the notice on the fifth day after mailing and the five days notice required by law begins to run on the fifth day after mailing. 
  • Certified Mail and Personal Service: This option in almost all cases allows you to file the eviction lawsuit sooner than the Certified Mail Only option.  If you select this option, we send the notice by certified mail and we attempt personal service on the tenant at the property using a licensed process server.  It can have much more impact on a tenant if the notice comes from a law firm and is served by a process server.  If our process server can't make a hand delivery of the notice to the tenant the notice is posted on the front door of the property.   Our low price is based on the volume of notices we serve.

Terms of Engagement

For the indicated fees, we will prepare one notice letter tailored to the specific type of breach by your tenant.  Please note that if you engage us to serve a notice on your behalf and then ask us cancel service of the notice, we will charge you a service fee of $65. We will refund the balance to you. This is because shortly after receipt of your engagement we create a matter in our database, generate the notice letter and forward it to our process server. Cancelling the service requires more staff time and expense than completing the service. If our process server has already served the tenant when you ask us to cancel, you will be responsible for the full fee.
